The Board may act upon an item of business not appearing on the posted Agenda if the Board publicly identifies the item and one of the following occurs. The Board, by majority vote of the full Board, decides that an emergency exists, as defined in Government Code Section 54956.5; Upon a decision by a 2/3 vote of the Board, or if less than 2/3 of the Board Members are present, a unanimous vote of those present decides that there is a need to act immediately and that the need to take action came to the District's attention after the Agenda was posted; or the item was on the Agenda of a prior Meeting of the Board occurring not more than five calendar days prior to the date of this Meeting, and at the prior Meeting the item was continued to this Meeting. BB 9323(b), Meeting Conduct, provides the opportunity for the public to address the Board on matters that are not listed on the Agenda. The right to address the Board does not exempt the speaker from any potential liability or defamation. Persons wishing to address the Board shall include their name on the "Request to Address the Board" form provided. Individual speakers shall be allowed five minutes to address the Board on each Agenda or non-Agenda item. The Board shall not take action at that time except as allowed by law.
